Kirk Nevada Walker, Esq. of Nevada Walker, PLLC obtained a defense ruling after trial in the matter of David R. Stevens v. A&J Flooring Solutions. Stevens sued Defendant for breach of contract and construction deficiencies for a large flooring project. A&J Flooring Solutions counter-sued for the unpaid remaining payment of the contract and argued that the damage was from product failure and not improper installation.
After trial, the Court ruled in favor of Defendant finding that there was no evidence that the installation caused the damage to the floor and ruled in favor of Defendant. The Court also ruled that the counter-claim was valid and should be paid by Stevens. The Court thereafter awarded A&J Flooring Solutions fees and costs incurred in the matter, in addition to the remainder value of the original construction contract.Back
